Sedona Canada Principles
The Sedona Canada Principles are the leading Canadian guide to e-discovery practice, published by the Sedona Conference Canada Working Group, now in their 3rd edition.
The Sedona Canada Principles cover the substantive issues that arise in Canadian e-discovery: proportionality (Principle 2), default formats for production, the obligation to cooperate, the use of technology-assisted review, and the handling of privileged content.
The Principles do not have the force of law but are widely cited by Canadian courts as authoritative guidance. The 3rd edition, published in 2022, updates the framework for cloud-native ESI, technology-assisted review, and modern data-preservation challenges.
For e-discovery practitioners and counsel, the Principles are the default reference for scoping and proportionality arguments. Production protocols often cite specific Principles to support their structure.
